§ 17-3. Use and repair of streets, roadways and alleys.

  • (a)

    This section shall apply to any person, firm, corporation, agency or governmental entity using or crossing any street, roadway, sidewalk, alley, right-of-way, easement or similar property or property right of the City of Gautier.

    (b)

    The public works director of the City of Gautier shall be notified in writing no less than five (5) days prior to any proposed cuts, alterations, or disturbances of paved or unpaved ground within any right-of-way owned or controlled by the City of Gautier.

    (c)

    If the disturbance consists of more than one hundred (100) linear feet, notification must be not less than ten (10) working days.

    (d)

    In cases of any disturbance of pavement, sidewalk, driveways or other unnatural surfacing, the person, firm, corporation, agency or entity shall at its own cost and in a manner approved by the City of Gautier, replace and restore all paving, sidewalks, driveways or unnatural surfaces to a pre-existing condition not more than ten (10) working days after completion of the work, unless additional time is granted by the public works director.

    (e)

    Any holes or trench work across, along and/or in sidewalks, driveways, streets and roadways shall be backfilled with appropriate new material, e.g. "Class 9 Group B Clay" which shall be compacted mechanically with a vibrator or tamper at every eight-to-ten-inch lift prior to repaving. Resurfacing shall be a minimum of a three-inch lift on bituminous streets.

    (f)

    In lieu of backfilling with sandy material, it will be permissible to backfill with hot asphalt where weather conditions will not allow suitable compaction or backfill material, and the repair area cannot be closed for extended periods of time to allow for good weather. If the backfilling is over valves and/or fittings, river sand or gravel may be placed over the valve and/or fitting with ground asphalt used as the remainder of the fill and hot asphalt as a cap.

    (g)

    If the repair of the street, sidewalk, driveway or roadway result in sinking, the depression shall be addressed through added lifts of asphalt.

    (h)

    The city public works department shall provide to all persons, firms, corporations, agencies or governmental entities who have been granted use of the city's rights-of-way a list of all streets proposed for paving or overlaying, at the time such list is adopted and when requests for purchase orders for paving are issued.
