§ 18.5-27. Violations.

  • (a)

    Any person who shall violate the provisions of this article shall be deemed guilty of a misdemeanor and shall on conviction, be fined not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000.00) per tree that has been unlawfully removed, damaged, or destroyed.

    (b)

    Any protected tree that is unlawfully destroyed shall be replaced by the responsible person at no less than a two to one ratio. It shall be the prerogative of the planning director to specify alternate public property locations for planting of required replacement trees. Said replacement trees shall be planted in accordance with the city ordinance requirements. The type, size and number of replacement trees shall be determined by the planned director.
