§ 2. Notice of appeal and contents.

  • (a)

    In the event that an applicant is aggrieved by the decision of the planning commission or the board of adjustments, the applicant shall file a notice of appeal with the city clerk within ten (10) days from the date of the rendering of the decision by said commission or board.

    (b)

    The notice of the appeal shall be in writing and shall contain the following:

    (1)

    The name, address, and telephone number of the party instituting the appeal.

    (2)

    A brief statement which shall set out separately and particularly each error which the applicant asserts or intends to assert was committed by the planning commission or the board of adjustments. (No error not distinctly assigned shall be heard or considered on appeal.)

    (3)

    A request for oral argument or waiver of oral argument before the city council as provided for in Procedure 6.
