§ 3. Record on appeal.

  • (a)

    All appeals to the city council from decisions of the planning commission and board of adjustments shall be upon the record made before said bodies and in compliance with Article VI, section 4, of the zoning regulations of the City of Gautier, Mississippi. It is the responsibility of the applicant to ensure at the hearing before the planning commission or the board of adjustments that a complete and accurate record is made of all proceedings therein and that all exhibits, and attachments are included in the record. Matters outside of the record shall not be considered by the city council on appeal.

    (b)

    The original papers and exhibits filed with the planning commission or the board of adjustments, the transcript of the proceedings, and any and all other exhibits attached to the transcript at the time of the hearing before the planning commission or the board of adjustments shall constitute the record on appeal of all cases.
